I see valid points on both sides of the argument. I'd be pissed if I were scammed at ebay and Hans really must protect his product.
For me, Hans has always been a great person to do business with and digitali16 seems to be a genuine honest arcade webmaster judging by the many post I read here occasionally. So I don't like to see people saying bad things about either of them...so that's why I posted (I hate posting on these type of topics) |

Thanks woochoo I appreciate your comments and we are still up at 1:48AM working on getting our site back up. Hans is a sleep now and will be back up tomorrow to run his business and that is fine with me. I just want to be left alone so we can run our business. When I get my site back up some people will understand that at this point the site was nothing like that original script and I am not just talking about skins and templates either.
Hell while we are on that subject let me point something out. NOOBs read this and take it to heart because if you apply it then it will cut 3 - 4 months off establishing your site. I read a post by Ken who owns bootyarcade and I talked to him once on IM and he completely insulted everything in the template and said my site sucked LOL. I smiled because most of that stuff was there to begin with ( the 10% that was the same ) but we went back and made SEVERAL more changes. Anyone can copy something but the problem is if you don't understand how and why it works you still are light years behind the originator. I took the ENTIRE right hand side of our page and dedicated it to Links going out ( ken does this ). I did not just copy everything he done however instead I tried to understand what he was doing and why it worked. He told me " Thumbs get Clicks ". Don't let me paint him as a gentle and kind soul either because he talked about our site like a dog. I did not care because this is a business and anything one man can do there are 2 of us around to try and do it better. So we went in and added hot code with plasma fire over the promoted thumbs. I did not just copy his rather large and sexy thumbs but I took what he told me and put my spin on it. Ken has some curiousity click things on his site that react to mouseover. We built a flash script with mouseover and sounds. Again just his concept but wait there is an Ebook called " traffic from scratch " where I heard the same thing. Let me say that when our site is up I went from sending out 100 clicks total to some days as much as 1800. This had more to do with chatting on IM with Ken than any buggy 2 year old script. There were so many problems if I had to do it again I would have just thrown the entire thing out all together. Here is something else as well. The plugs were framed meaning they don't show up so trades will SUCK. Also when someone clicked they left my site completely and once we altered this as well we could get 2 or 3 clicks and send them to different sites ( I got that from listening to Mark of funklicks ). You want to say I stole something then have something worth stealing Hans. I just gave alot of NOOBs some good FREE information that I busted my hump with my brother for the last 8 months to execute but it still only scratches the surface of what we have planned. I DONT NEED to steal a very basic buggy script that is dated and 2 years old. I would have gladly networked with hans and helped him improve his script from the point of an active user but instead of doing BUSINESS he reacted like a child. Again I try to be the nicest guy I can be but I want be insulted and ran over by anyone so if you want to call me out in public and say I am a warez stealing thief you better have your facts straight and you better have something worth stealing.

Sometimes when trying to make a claim like Hans is doing you have to be careful because you could just end up tainting your reputation and people won't consider doing business with you. Just like what Solidgamers said

Hans sent me an email too today, regarding Kedoba.Com. I supplied him with screenshots of the paypal transaction of the eBay sale, with details of the sellers id and Hans very kindly licensed my site free of charge. Like digital16, who bought the same script from the same auction as me, I found no trace of any onarcade copyright anywhere in any of the script files.
I have absolutely no complaints about Hans whatsoever, he has acted with complete integrity. Please steer clear of the scammer who sold me the script, illegally. His eBay ID is soeharyo88, avoid at all costs. Kev

digital16, I'm not saying it's right to pay Hans. But you made a point that you are losing money while the site is down... so I would assume that it would benefit you to get this all cleared up with Hans......and it seems to be a money issue with the guy.
Hans, you should have pointed out that you let Kedoba keep their site...they faced the same issue. That's kinda shady on your part. I'm not saying you're a bad guy...but that's not right. |

Honestly all this takes is Hans to provide some evidence that there are unique aspects of onArcade that were part of Gubug. Hans did provide some aspects of Gubug that are the exact as what was in OnArcade. I know the owner of Gubug mentioned they re-coded over 90% of whatever they purchased from eBay, but it should still be easy as comparing both scripts to see if similarities. But also on the other hand, if it truly was OnArcade at the beginning, it doesn't matter if GuBug recoded 90% of 1%, it was still OnArcade at the beginning.
The argument that so and so purchased the script on ebay and therefore should be entitled to a free or discounted license is not a good argument at all. Neither is the argument that something was an older version or buggy so it should be free. If the script indeed was v1 or v-whatever of onArcade it requires to be licensed. Basically its like saying since Microsoft released VISTA and that there are bugs in Windows XP, that Windows XP should be free for everyone and everyone has the right to do what they want with it. I am not taking sides in this matter, but if Hans believed that Gubug was running onArcade and indeed sent email requests to GuBug regarding it and did not hear anything back, Hans had the right to proceed with his/her actions and most likely filed a DCMA request with Hostgator. All it takes (at least from what I was reading at HostGator) is providing proof to H ostgator that what Gubug was running was not OnArcade. I'm guessing it would have to be something that refutes OnArcade's claim on the DCMA they filed with the company. But I also wonder if this could've been settled as easy as the other person who psoted in this thread they acquired an onArcade license from ebay and Hans gave them a free license. Not that Hans should be required in any way, shape or form to do so, but I wonder if GuBug just responded to Hans' emails, this might not have even happened. I wish both parties luck in getting this resolved without either company losing revenue ... and I also want to apologize to all those who are still reading this post as I didn't think it would be this long of a post.
