Now I am not goint to agree or disagree with anyone but I will say this:

digitali16 - the forgotton password uses the exact same text as onarcade... well according to the example above and other things do look really similar. Hans also said he did email you to which you did not respond. If there was contact between both of you hopefully things would have worked better it is a real shame to see well what appears to be two good arcade builders/webmasters fighting over intellectual property.

Hans - I use Onarcade and have 2 purchased copies, both work well for me and I have had many modifications made to my site and have asked Hans every time and he helped me without any hesitation.

Hopefully you guys can both sort this out in a friendly manner and put any beef behind you Good luck and I hope everything goes well for both sides.

BTW hans you are comparing Kedoba with your old script but that looks nothing like mine. You don't even have an about me section for guys to write a blurb in.

and somehow these default avatars made by 2 different authors ended up being exactly the same size, colors and text position? And somehow admin panel login pages have exactly the same source code?

Avators Dude we just added 400 avatars that members can add to their profile with 1 click
and BTW my about me looks nothing like yours
these are just some addons, adding few features doesn't make the script yours. Does talkarcades.com look like vBulletin? Not very much, but it still is vBulletin.

well, that is because your site is down and you said that you are using the same script.

Hans we have been working on our script for months now. I would say that it is almost nothing like what we started with. You keep comparing it to kedoba but our site is not even anything like his site. Also I never got any Email from you and this is costing me alot of money and time for something you feel that you wrote 2+ years ago and NO longer sell. Maybe the reason so much stuff looks the same is because you took it from open source code and added prefixes saying on arcade and my brother could come on here and point out tons of opensource code that was in that script. I don't knock your business man and I did not start this but when you take food off my plate and make us waste time like we are doing today I do take offense.

it doesn't matter that your site might have few extra mods, it is still based on that same script and that script belongs to me.

I think Hans is taking it too far give him some slack like digitali16 said he bought it off ebay. It probably had all copyright notes removed from every script and was undefined as to who created it. It would be totally wrong if Hans expected digitali16 to pay for a license.

I think it's a shame that Hostgator royally screwed their own customer can we boycott them?

There was no reference to onarcade at all in what I paid for on ebay.
http://www.loadstuff.com/
This is Hans v1.0
http://www.onarcade.com/onarcade10/

My gubug site does not look like either of these. I am sorry hans but we will not put in 8 months of work and then pay you for a license for something we paid for already. All arcade scripts are going to look somewhat alike because they are arcade scripts. All forums basically look very similar because they are forums. Anytime you become a leader in developing anything online there will soon be 40 x 40 things that look similar. At the core of everything an arcade script is just a simple CMS that handles flash games and your version 1.0 seems to me to be just that. There was no referrence of onarcade during the setup of this script at all. So you should understand our point and under the hood 90% of what was on the original scipt has been redone.

I can't just give free license to anyone who claims that he has bought my script from eBay.

there was nothing they could have done, there are laws that oblige them to take actions.

yes, all arcades look similar, but not all use onArcade code. Your site might look a bit different from www.loadstuff.com and www.kedoba.com, but it still used the same code... it even had that same pagination bug http://www.loadstuff.com/index.php?action=search that was in onArcade 1 (and I think even in 1.1).

Also, if the code was so bad that you had to recode 90% of it (it actually was bad, I was young and stupid...), then why didn't you just write your own script?

Dude that is my point. We really have writen our own script. That pagination bug is fixed in ours and you still don't even have checks to stop someone from just coming in and joining and running up 2000+ gameplays in a day. We fixed that also because it makes it IMPOSIBLE to know how effective your promition is and hinders guys from joining the arcade because what is the point when they will never make the toplist with cheaters around. We added rotating ads from several networks that rotate automatically to fight ad blindness and increased our CTR 240%. We did write Gubug and under the hood there is no referrence to on arcade at all and there was never one when we bought our script. We tried to keep some of what we paid for so that is why we say that 90% of the source has changed. I can't just pay everyone that says I have code from them when I know 90% of my site has been rewriten.

Also I have been a very active member of this forum now for about 8 months and it seems you don't have any problem contacting me here now. So why do you say that you tried to contact us? Maybe you think you can squeeze us for a license fee on work we already done for ourself but to pay you a license fee is to legally state that you wrote our script wich you simply did not do my friend.

My brother is itching to come on this forum and see just how much of a coder you really are because even the script you just released had bugs and ofcourse guys will thank you for fixing them but before you charge someone for something then why not correct the problems properly? Who are you Bill Gates? Also some of the problems you had from what it looks like to us came about because you took bits and pieces of code that was expecting a different database schema and implemented into your script ( Now how is this your code ? ). You see my brother has forgotten more about coding then you probably ever will know, and has experience programming on several platforms and if you like we can point out lots of instances where you took opensource code and simply added referrences to your script. I am not here for this however and that is so far away from what my brother is about that this is why he almost NEVER joins forums. I just think you handled this poorly and I contend that we have not in anyway infringed on your code. Yes Hostgator could have checked to see if you actually owned copyright because as they work now ANYONE can file a DMCA claim just like we have filed a counter claim and have our code to prove it. You make it sound like everyone with an arcade owes you a license fee for using basic PHP and MYSQL functions.
